Pedestrian Struck and Killed by Car on I-95 in Volusia County

By Orlando Personal Injury Attorney on July 22, 2020

Traffic along a heavily traveled road in Volusia County was interrupted and diverted on Thursday, July 16th, after an accident involving a pedestrian and a car. A collision report filed by members of the Florida Highway Patrol working within Volusia County indicated that the event took place sometime close to 12:30 in the afternoon when many people who still leave their home to work were traveling about during their lunch break.

At this time, a pedestrian was walking along the shoulder of Interstate 95. As is the case with most highways, I-95 does not feature a sidewalk running along the asphalt. This means that the pedestrian was walking along either the grass or the asphalt on the shoulder of the road. While neither of these options are entirely safe, and while the side of the highway is in general not the place for pedestrians, it is still the responsibility of drivers passing through these areas to keep their attention on the road and their surroundings. This includes being aware of any unexpected things, such as pedestrians, that might appear.

The driver of the car in question was perhaps paying attention to the road around them, but it is also the case that as they entered an area of I-95 north of mile marker 273 they reached the stretch of the road where the pedestrian was walking. While the details of how the car and the pedestrian came to cross paths is still the subject of an investigation, we do know that the car collided with the pedestrian while still traveling at an advanced rate of speed.

When the paramedics and EMTs reached the area, there was little that they could do for the badly injured pedestrian. The driver of the car remained at the crash site throughout the preliminary investigation, and the emergency medical response crews attempted to revive and tend to the pedestrian while the Florida Highway Patrol spoke to the driver of the car.

The pedestrian was declared dead at the scene of the incident. They were not identified in the initial reports.

While the crash was being investigated, the northbound lanes of I-95 in the area were closed and all traffic was directed down U.S. 1.
