Pedestrian in Serious Condition After Being Struck by Car in Daytona Beach

By Orlando Personal Injury Attorney on June 19, 2019

On Saturday, June 15th, police working within Daytona Beach received reports about a car vs. pedestrian accident that had taken place along Nova Road. According to the report filed by the Daytona Beach Police Department, the incident happened sometime during the night, although the initial updates on the story did not mention the specific time. What we do know is that the pedestrian was a 49-year-old who was crossing the road on foot when a black Nissan Maxima approached the area.

Preliminary investigative efforts indicated that the collision happened after the 49-year-old left the sidewalk and began to try and cross the busy road. It is not clear if the pedestrian felt that the road was clear enough at that particular moment, or if they were simply not aware of the volume of traffic traveling down Nova Road. The reports made clear to state that there was no evidence that the pedestrian was trying to use a crosswalk, which means that the drivers coming down the roadway were likely unaware of the presence of the pedestrian. It was not immediately clear if there is a crosswalk close to the area where the pedestrian attempted to cross or if that particular stretch of Nova Road doesn’t feature any sort of pedestrian safety zones.

The driver of the Nissan Maxima either failed to see the pedestrian or was unable to swerve out of the way in time. The car struck the 49-year-old and through them through the air and onto the pavement. When paramedics and EMTs reached the area they immediately began to tend to the badly injured person who was then loaded into an ambulance and rushed to Halifax Health Medical Center. The report stated that the injured pedestrian was admitted with serious injuries. At the time of this writing, it is not known if this person is still in serious condition.

According to the early reports, the police are not pursuing charges against the driver of the Nissan, citing the fact that the pedestrian was not inside of a crosswalk as reason enough to free the driver from all culpability.
