Injured Passenger Seeks Damages for Orlando Car Crash

In a personal injury case currently pending with the Orange County Circuit Court, the plaintiff is seeking damages for injuries that he sustained during an Orlando auto accident that happened earlier this year. The plaintiff was a passenger in vehicle that was hit by a car driven by the defendant.

On March 2nd, 2018, the plaintiff was a passenger in a vehicle heading northbound on Chickasaw Trail in Orlando when it was hit by a 2011 Toyota Corolla driven by the defendant. The plaintiff alleges that he suffered permanent injuries, physical and mental pain, impairment and disfigurement as a result of the accident and seeks more than $15,000 in damages plus costs.

In order to recover such damages, the plaintiff will first need to prove that the other driver (i.e., the defendant) was in fact at fault. This requires a showing of negligence on the part of the defendant. In the case at hand, the plaintiff alleges that the defendant negligently attempted to make an improper lane change, that this negligent act caused the accident and that the accident is what caused his injuries.

To prove such negligence, however, will require the use of evidence. As to the negligent lane change, the plaintiff and his attorney will likely rely on the testimony of the driver of the vehicle he was in, the police report and any other witnesses to the accident. As to his injuries, evidence will likely go to his medical records and the expert testimony of the plaintiff’s doctor(s). At the same time, the defendant will have an equal opportunity to present evidence to the contrary. This could include evidence that the driver of the plaintiff’s car was in fact negligent, or that the plaintiff was not in fact injured to the extent that he claims.
