Orlando Driver Hits Several Parked Cars
A recent Orlando car accident left two people in the hospital – including one listed as being on trauma alert. According to the Florida Highway Patrol (FHP), a driver swerved and hit several cars parked at the Lakeview Apartments complex, a gated community located at 4444 Rio Grande Avenue. Both the driver and the passenger were transported to the Orlando Regional Medical Center. Nobody else was injured. The cause of the accident remains unknown, and the FHP is continuing to investigate the case.
Depending on what caused the driver to swerve, both the passenger and the owners of the vehicles that were hit could have standing to seek compensation for their injuries and damaged property. However, this will depend on whether or not the driver acted negligently. For example, if the driver swerved because they were texting or had fallen asleep, then they will be found negligent and thus responsible for the damage and injuries that their negligent driving caused. If, however, the driver swerved to avoid hitting a child or even an animal that had run into the street, this will likely be considered normal driving under the circumstances. Thus, as they were not driving negligently, they will most likely not be responsible for the injuries and damage they caused.
If the driver is found to have been negligent, then they could be facing multiple lawsuits. First, the passenger could sue in order to be compensated for his or her injuries. Considering that the injuries required a trip to the hospital, the expenses could be substantial. If the injuries cause the passenger to have to undergo future medical treatment and/or lose time from work, then they can also seek compensation for these losses. Likewise, the owners of the parked vehicles can also seek compensation for the damage done to their cars. Typically, such compensation will be limited to the actual cost of the repairs or, depending on the extent of the damage, the cost of replacing the vehicle.
