Orlando Driver Crashes into Auto Mall
Over the Memorial Day weekend, a 47 year old man was killed when his 1999 Mercedes-Benz crashed into a light pole on into an auto mall located on Orlando’s Colonial Drive. According to the Florida Highway Patrol (FHP), the driver was traveling eastbound near Old Cheney Highway when he lost control of the vehicle and veered off the road. Upon impact with the pole, the car split into two pieces, ending up in the auto mall. Eight vehicles in the mall’s lot were damaged when the Mercedes crashed into them.
When we talk about damages within the context of an Orlando motor vehicle accident, typically we think about injuries and the medical costs and loss of ability to work that extend from those injuries. In those cases, the injured party could file a personal injury lawsuit against the negligent driver who caused the accident in order to get compensation for these injury-related damages. However, most automobile accidents also involve another type of damages – as the case at hand makes abundantly clear: damage to other vehicles.
Just as one can seek compensation for their personal injuries, one can also seek compensation for the damage done to one’s motor vehicle. So long as the injured party can show that the damage was caused by the negligence action of the other driver, then they can seek compensation to cover the costs of repairing or replacing the damaged vehicle.
In the case at hand, although it remains unknown what caused the driver to lose control, in all likelihood they were driving negligently (such as too fast or under the influence of drugs or alcohol). Because of this negligence, they crashed into and damaged the eight cars located on the auto mall lot. As a result, the owner of the auto mall can seek compensation for these damages – which could be hefty if the cars were new. However, because the driver in the case was killed, the auto mall owner would have to seek compensation from either the driver’s insurance or via their estate.
