Failure to Stop Causes Accident, Injuries in Suwannee County

By Orlando Personal Injury Attorney on January 27, 2016

Two Florida men, one from Branford and the other from Fort White, were airlifted to the University of Florida’s Shands Hospital following a weekend two vehicle accident. According to the Florida Highway Patrol (FHP), the 55 year old Fort White man was driving his 1999 Toyota Camry north on County Road 137 near the intersection with State Road 247 in southeastern Suwannee County (northeast of Branford, east of O’Brien). The other driver, age 65, was headed south on State Road 247 in his 2015 Ford Expedition, also approaching the intersection with County Road 137.

According to the accident report, the 55 year old Fort White native failed to stop at the posted stop sign at the intersection. As he entered the path of the oncoming Ford Expedition, the Camry was struck on the passenger side by the front right corner of the SUV. Following the impact, both vehicles came to a stop at the intersection’s northwest corner. The report says one driver and their passenger, a 62 year old female from Branford, were airlifted to the hospital with serious injuries. The other driver sustained only minor injuries.

In the case at hand, the injured parties will likely have the legal right to seek compensation for their injuries. To do so, they will have to file what is known as a personal injury lawsuit. The basis of this lawsuit is that the other driver acted in a negligent or reckless manner in his failure to stop at the posted stop sign. As this failure to stop was what caused the accident and their injuries, the victims here likely satisfy all the required elements for establishing negligence in accordance to Florida law. As such, they will likely be in the position to seek compensation for such damages as:

  • Medical bills
  • Future medical bills
  • Damage to the vehicle
  • Loss of income
  • Future loss of income
  • Pain and suffering
