Orlando Man Sues Driver for $15,000 in Damages
An Orlando man who was injured during a 2017 automobile accident has filed a Florida personal injury lawsuit against the driver of the other vehicle. In the suit, the plaintiff is seeking over $15,000 in damages, based on the claim that the December 18, 2017, car crash left him seriously injured and disabled. The crash happened near the intersection of Crystal Creek Boulevard and the John Young Parkway in Orlando.
According to the court filing, the plaintiff believes that the other driver, or the defendant, had acted negligently and that this negligence caused the accident and his injuries. Specifically, he claims that the defendant acted negligently in her failure to pay attention to traffic and keep a proper lookout for other vehicles and failed to maintain a proper speed and distance between vehicles needed to avoid a crash. As a result of the defendant’s carelessness and failure to exercise the standard care and skill required to safely operate a motor vehicle, the plaintiff has resulted in:
- Pain and suffering
- Disability
- Loss of capacity for the enjoyment of life
- Medical care and treatment
- Loss of earnings
Unless settled out of court, the lawsuit will be decided by a jury trial. The plaintiff, through his attorney, has the responsibility of proving that a) the defendant acted negligently, b) that her negligence caused the accident and c) that as a result of the accident the plaintiff has suffered damages. To prove his case, the plaintiff will likely rely on medical records, the police report and, in some circumstances, expert witnesses.
Likewise, the defendant, through her attorney, will have the opportunity to demonstrate why she is not responsible for the alleged injuries and damages. She may also make an argument that the damages being sought are not representative of the actual damages that the plaintiff has suffered.
