Orlando Driver Loses Control, Crashes into Home
A 24 year old from Orlando, Florida was hospitalized recently after his BMW crashed into a local home. According to the Florida Highway Patrol (FHP), the crash happened at 1:00 Friday morning. The driver, whose name has not been released, was driving on Chickasaw Trail when he lost control of his vehicle. The BMW hit a guardrail and brick wall before crashing into a home located on Moritz Court. Upon impact, the car burst into flames. The driver was taken to a nearby hospital where he remains in critical condition. The police say that although there were people inside the home at the time of the accident, luckily nobody was injured – although the house did sustain substantial damage.
Although the exact cause of the accident remains under investigation, neighborhood residents say the area is no stranger to car crashes. One witness told a local news station that the curve where the accident happened is very dangerous, and that there have been several accidents on it. “We’ve seen everything from tractor-trailers going sideways, to motorcycles sliding and hitting the pole,” the witness told Orlando’s Channel 9 news.
In the case at hand, the owners of the house will likely be able to seek compensation for the damage caused to their house. To do so, they will have to show that the damage was caused by the negligent act of another. Most likely, this will be the driver of the BMW who, for example, could have been driving too fast for the curve, been distracted while driving or had been driving while intoxicated. These would all be considered negligent acts that caused the accident and the subsequent damage to the Moritz Court home.
However, if what the witness says is true and that the curve is dangerous and the cause of numerous accidents, then there is a chance that the driver and the home owners could sue the city for failure to properly mark the curve with signage and or lighting.
