Multiple Vehicle Accident Reported in St. Johns County, Florida
According to the St Johns County, Florida Fire and Rescue authorities, a multiple vehicle accident was reported on US Highway 1 near the Las Colinas neighborhood. The accident, which happened during the afternoon of January 3, 2017, left one dead, one injured and all southbound lanes closed for hours.
According to the St Johns County Facebook page, emergency crews arrived at the scene and found a multiple vehicle accident causing “complete road blockage”. Firefighters evaluated two victims, one who was pronounced dead at the scene and another who was transported to a nearby trauma center where they remain in serious condition.
At this time, the cause of the accident remains unknown and under investigation.
Depending on the circumstances of this accident, the individual who was injured could be able to file a lawsuit seeking compensation for his or her injuries. According to Florida law, if one is injured as a result of the negligent, reckless or criminal actions of another and those injuries caused damage, then they have the legal right to file a personal injury lawsuit against the other individual. In the case at hand, for example, if the driver who was killed was responsible for the accident (such as speeding or driving under the influence), then the injured party could seek compensation from the decedent’s estate for their medical bills and treatment, future medical treatment, loss of income, future loss of income, damage to their vehicle and pain and suffering.
On the other hand, and again completely dependent on the circumstances of the accident, if the victim who died was killed as a result of the negligent, reckless or criminal action of the driver who was injured, then they could take legal recourse against the injured driver. However, because they were unfortunately killed in the accident, personal injury law does not apply. Instead, the surviving family could seek compensation in accordance with Florida’s wrongful death statute.
