Failure to Negotiate Curve Causes Florida Car Crash
A Florida car crash in Osceola County earlier this week left one person dead and two others seriously injured. According to the Florida Highway Patrol (FHP), a 39-year-old male from Pennsylvania was driving his four door Chevrolet north on Canoe Creek Road. Failing to properly negotiate a curve, his car veered into the road’s southbound lane where it struck the left side of an oncoming Ford pickup truck.
The driver of the Chevrolet was killed in the crash. The driver and passenger of the Ford, a 71-year-old male and 65-year-old female respectively, were taken to Osceola Regional Medical Center where they were treated for serious injuries.
Although the crash remains under investigation, police have confirmed that all three individuals involved in the crash were wearing seatbelts. It has also been confirmed that neither driver was under the influence of drugs or alcohol at the time of the crash. That being the case, the cause of the accident is likely reckless driving. For example, when a driver fails to properly negotiate a curve, often times it is because he or she is speeding or driving while distracted (i.e., texting while driving, talking to someone else in the car, etc.).
If this accident was in fact caused by the Chevrolet driver’s reckless driving, and this reckless driving caused the accident and subsequent injuries to the two individuals in the Ford pickup truck, then both the Ford driver and passenger would have legal grounds to seek compensation for their injuries. They would do this by filing a Florida personal injury lawsuit. However, as the negligent driver was killed in this accident, the lawsuit would be filed against his estate.
In their personal injury action, the Ford driver and passenger could seek compensation for their:
- Medical bills
- Future medical treatment
- Loss of income
- Future loss of income
- Repair or replacement of their vehicle
- Emotional distress
