Chain Reaction Accident Leaves One Dead Near Orlando
An Orlando man died following an automobile crash on State Road 528 last Friday – a chain reaction crash that also left three others injured. According to the Florida Highway Patrol (FHP), the accident started when a 31 year old male driver rear ended a 2013 BMW driven by a 37 year old male driver in the westbound lanes of State Road 528 at mile marker 31 in Orange County, Florida. The rear end accident left the BMW in the left late.
Following the accident, the 31 year old driver then got out of his car and was standing outside the driver’s side window of the BMW talking to that driver when a 2013 Hyundai driven by a 25 year old male hit the back of the BMW – the force of which caused the man standing outside to be thrown to the ground. Although he survived, a passenger in the BMW, a 44 year old male, was killed upon impact. All three drives were taken to Orlando Regional Medical Center for injuries that ranged from critical to minor.
As this accident remains under investigation, we do not know why the driver of the Hyundai was unable to stop. Perhaps he was driving while distracted by a mobile phone and did not see the accident ahead until it was too late? Or perhaps he was speeding and couldn’t stop in time? Or perhaps he wasn’t doing anything wrong and just was unable to stop? These questions are important as they will impact any legal case that comes from the incident. For example, if the injured drivers or the family of the deceased passenger file a lawsuit against the driver of the Hyundai, the first question will be whether or not the Hyundai driver was at fault. If so, then the lawsuit can proceed. If not, then the Hyundai driver will not be held liable for the damage caused by the accident.
Determining whether or not one is at fault is a complex issue and one that should be left to an experienced Orlando automobile accident attorney. If you or a loved one have been injured in an Orlando car accident, contact the Law Offices of James O. Cunningham, P.A. today.
