A1A Car Accident Leaves 23 Year Old Dead

By Orlando Personal Injury Attorney on January 30, 2017

A 23 year old male from Ponte Vedra Beach, Florida was killed last week during a car accident that happened on A1A. The driver was driving his 2006 Acura TSX north on the highway in Ponte Vedra when, according to reports, he lost control and failed to negotiate the curve near Gnarled Oaks Drive by the intersection with Mickler Road. According to the Florida Highway Patrol (FHP), the car then left the road and overturned in a ditch. Emergency responders pronounced the driver dead at the scene.

Although the death of the driver is tragic, it is very lucky that nobody else – whether another vehicle or a pedestrian on the side of the road – was injured. If there had been another victim, it is likely that they would have a strong case against the driver for negligent driving.

When someone is injured due to the negligent or reckless driving of another, they have the legal right to seek compensation for their injuries. To do so, they must file a Florida personal injury lawsuit that clearly shows that the negligent act of the defendant was the cause of their injuries and, as a result of the injuries, they have sustained damages. This latter requirement means that the injured must show that they have ‘lost’ something due to their injury. In other words, if one is merely bruised in an accident but the bruise doesn’t cost them anything, then they cannot file a lawsuit. Common types of damages that a court will compensate one for include:

  • Medical bills
  • Future medical bills
  • Damage to property
  • Loss of income
  • Future loss of income
  • Pain and suffering
