Decision Challenges Florida’s Cap on Medical Malpractice Claims

According to a recent article in the Orlando Sentinel, a court decision could end up serving as “another blow to a controversial 2003 law that limits the amounts of money injured patients can receive in medical malpractice cases.” The case being discussed involved a dental assistant who underwent carpal tunnel surgery and ended up with a perforated esophagus. The assistant, Susan Kalitan, was injured as a result of tubes being placed in her mouth and esophagus as part of the pre-surgery anesthesia process.

Florida Crash on Three Oaks Parkway Results in Fatality

A 21-year-old man was driving a 1998 Lexus sedan north along Three Oaks Parkway in Estero on Sunday morning at approximately 2:40 a.m., when he lost control of his vehicle. According to the Florida Highway Patrol, the Lexus drifted into the grassy median and began to spin clockwise. As the vehicle was rotating, the front end of the car slammed into a tree, bringing it to a stop. It was reported that the driver died at the scene of the accident. The accident remains under investigation and few details are known at this time. It is also unknown if speed or fatigue were factors in the incident.

Florida Drivers More At-Risk For Injury Due to Faulty Airbags

A report released by the Traffic Safety Administration on Tuesday indicates that nearly 75% of the ruptured faulty airbags they have tested that were manufactured by Takata are from the State of Florida. Officials cite the heat and humidity associated with Florida weather as factors in the high rate of rupture of these airbags. The airbags expand with such force that they can potentially propel shrapnel throughout the vehicle, severely injuring occupants.

Single-Vehicle Crash on Florida Turnpike

A 29-year-old woman was killed on the first weekend of July in an accident on Florida’s Turnpike in Osceola County. According to the Florida Highway Patrol, the woman, who was driving, lost control of her vehicle and it veered off the road and hit a tree. She was pronounced dead at the scene, while the only other passenger suffered minor injuries.

St. Augustine Beach Skateboarder Killed in Hit-and-Run

In mid-June, a young man was struck by a vehicle in St. Augustine Beach and killed. The accident was a hit-and-run. The victim, 23-year-old Casey McLendon, was on a skateboard when he was hit by a pickup truck that kept driving. According to witnesses, the crash sounded like a gun going off.

Florida’s Turnpike Crash Kills Father and Son
