Car Runs Red Light, Hits Disney Bus in Orlando

According to the Florida Highway Patrol (FHP), five people were injured this week when a man ran a red light and collided with a Disney World bus. The car accident happened near the Disney World resort in Orlando, Florida.

Although few details have been released, according to a local newspaper the driver slammed into the front of the bus, which was carrying 19 passengers. The bus driver was reportedly hospitalized with serious injuries. Two passengers were also taken to a nearby hospital for treatment of minor injuries. The 39 year old driver of the car, along with his passenger, were also transported to the hospital with reports of minor injuries.

It is unclear why the driver ran the red light. The local police say that charges are pending.

In the case at hand, the bus driver, the two bus passengers and, possibly, the passenger of the car, could seek compensation for their damages. To do so, they will have to file a Florida personal injury lawsuit against the 39 year old driver. Such a personal injury lawsuit should be fairly straight forward, especially for the bus driver and two bus passengers. In order to be able to receive compensation, they first need to show:

  • That the driver acted negligently
  • That the negligent act caused the accident
  • That they were injured as a direct result of the accident

Here, the driver’s failure to stop at a red light is a negligent act. Furthermore, his failure to stop is what caused his vehicle to hit the bus (i.e., if he had stopped, he wouldn’t have collided with the Disney bus). Finally, it was this collision that seriously injured the bus driver and caused minor injuries to the two bus passengers and the passenger in his car.

Because the three requirements are met, the injured parties have ground to seek compensation for their injuries, medical bills, future medical bills, and any loss of income.
