Wrong Way Accident in Orlando Leaves One Dead
An Orlando area driver was killed after traveling the wrong way on Interstate 95. According to the Florida Highway Patrol (FHP), the accident happened early Monday morning, around 2:15. The driver was driving their 2006 Chevy Cobalt northbound in the inside southbound lanes of I-95 when it hit a southbound 2005 Hyundai Tucson. The accident happened near the Palm Coast Parkway.
The driver of the Chevy Cobalt dies at the scene. The driver of the Tucson was taken to Halifax Hospital and remains in critical condition.
The accident remains under investigation, and charges are pending.
Your Right to Seek Compensation
According to the National Highway Traffic Safety Administration (NHTSA), wrong way accidents on interstates claim hundreds of lives every year. Causes can include everything from driving while intoxicated to being visually impaired. Sometimes drivers ignore signage, and sometimes they drive the wrong way on purpose. Regardless of why, the result is usually the same – serious injury or, in the worse case scenario, death.
When wrong way accidents happen, the victims have a right to seek compensation for their injuries. Thus, in the case at hand, the driver of the Tucson who was injured has the right to seek compensation for his or her injuries. This is because their injuries were caused by the negligent actions (i.e., driving on the wrong way of the interstate) of the driver of the Chevy Cobalt. In order to get this compensation, the Tucson driver will have to file a Florida personal injury lawsuit against the estate of the deceased Cobalt driver. If successful, the driver could receive compensation for:
- Past and future medical treatment
- Lost income
- Future lost earning (including suffering from a diminished ability to earn a living)
- Pain and suffering
- Damage to one’s vehicle
