Speeding Driver Dies in Orlando Crash
A Florida man was killed in an Orlando area automobile accident over the weekend. According to the Florida Highway Patrol (FHP), the crash happened shortly after 3:00 am on Saturday in Pine Hills, Florida, at the intersection of Colonia Drive and Hastings Street.
The driver, a 27 year old male, was speeding west on Colonial Drive when an eastbound car attempted to turn left onto Hastings Street. The driver’s Honda Accord slammed into the right side of the turning car, killing him instantly and seriously injuring the two female occupants of the turning car. The two females were taken to Orlando Regional Medical Center, where they remain in serious condition.
FHP says that the accident remains under investigation.
In the case at hand, the two injured females will likely be able to seek compensation for their injuries. They can do this by filing a Florida personal injury lawsuit against the driver (or, since the driver was killed in the accident, against his estate). Although the accident remains under investigation, based on the facts provided by a local new story, the accident was caused – at least in part – by the driver’s speeding.
In order to file a personal injury lawsuit against the driver’s estate, the injured females would first need to show that the driver in some way acted negligently and that this negligent act caused the accident and thus their injuries. In this case, the court would likely consider the driver’s speeding to be a negligent or reckless act that caused the accident and the female’s serious injuries. Thus, they would be entitled to compensation – known as damages. According to Florida law, these damages could include:
- Medical bills
- Lost earnings
- Vehicle repair
- Future economic loss, including loss of earning capacity and future medical treatment
