$1,425,000 Settlement for Good Samaritan Wrongful Death
Decedent was driving home late after work and witnessed driver of another vehicle close control and crash his car. As a Good Samaritan, client went out to see if she could render aid and assistance to the injured driver. While out in the roadway, client was struck and killed by a car as it travelled past the crash site.
The insurance company of the car that struck and killed client originally offered $0 to settle the claim, alleging the client’s negligence in going out into the road was solely responsible for her death.
Video footage obtained from client’s vehicle was sent to expert accident reconstructionist who was able to prove the driver that struck and killed client was traveling at a speed in excess of the posted speed limit and failed to reduce its speed as required by law when confronted with a hazard in the roadway. Case settled for $1,425,000 - the combined policy limits.
