$750,000 Settlement in Rear-End Distracted Driving Accident
Plaintiff was rear-ended by Defendant and pushed into vehicle in front of her. Defendant driver was from out of state and on his way to have his iPhone replaced when he struck clients car from the rear. During his deposition, Defendant driver denied being distracted and through his lawyer alleged client negligently stopped abruptly on an Interstate highway and that her unexpected stop was responsible for the accident.
Later, Mr. Cunningham took the deposition of a witness who testified he heard the defendant driver admit – on two separate occasions – that he took his eyes off the road twice causing the accident.
Case settled for $750,000 after hearing was set on Mr. Cunningham’s Motion for Partial Summary Judgment on the issues of liability, comparative negligence, and seatbelt defense. Type of Injury – Neck, Back, Head, had many injections and surgery on lumbar spine. The surgery on her back went badly Mr. Cunningham argued that the defendant was responsible for all injuries, including poor outcome of accident related- minimally invasive surgery.
