$500,000.00 recovery, truck collides with cow on Florida Turnpike, Marion County, Florida
Late one September evening, Frank Doe, a professional truck driver, was injured when his truck struck a cow that had wandered onto the Florida Turnpike. It was alleged that the Bigham Hide Cattle Company owned the cow involved in the accident. The morning prior to this accident, the Bigham Hide Company had received a call that one of its cows was wandering on the turnpike; however, they took no action to remove the cow from the road. The Florida Highway Patrol, with the assistance of cowhands from a neighboring ranch, was forced to remove the cow from the roadway and placed it back behind the fence. Although Bigham Company knew a cow wandering the road presented a serious threat to motorists, Bigham did not take any action prior to the accident to inspect their fence or restrain its cattle. Despite a forceful defense by the cattle company including a complete denial of responsibility and even ownership of the cow, the case was settled for $500,000 by Jim Cunningham just prior to the commencement of trial.
