Orlando Man Killed in I-75 Car Accident

By Orlando Personal Injury Attorney on January 6, 2017

According to the Florida Highway Patrol, a 73 year old man was killed while driving his 2005 Chrysler southbound on Interstate 75 near Orlando, Florida. The accident happened near mile marker 441. The police report states that the driver attempted to change lanes from the outside lane to the center one when a vehicle in that lane honked their horn to let him know of their presence.

The horn must have startled the driver as when he steered back into the outside lane he overcorrected, causing his vehicle to rotate counterclockwise into the grass shoulder, where it overturned multiple times before finally coming to a stop upside down and facing northeast in the outside lane. When emergency medical services arrived they pronounced the driver dead on the scene.

Although this Orlando car accident is tragic in itself, it could have been much worse. Had the other vehicle not honked their horn, this could have quickly escalated into a multiple vehicle accident, potentially resulting in numerous injuries or even deaths. If this was the case and, for example, the driver in the center lane was injured, that driver may have had grounds to file a personal lawsuit against driver’s estate. This is because, according to Florida law, one has the legal right to seek compensation for injuries caused by the negligent or reckless actions of another.

In order to get this compensation, an injured victim must file a personal injury lawsuit. Such an action has to show that the person being sued acted negligently or recklessly, that this negligent or reckless action caused the injury and that, as a result of this injury, the victim suffered damages. If these three items can be proved, then one has the right to get compensation to cover such damages as medical bills, future medical treatment, loss of wages, future loss of wages and pain and suffering – to name only a few.

If you or a loved one have been injured in an Orlando motor vehicle accident, you may have the legal right to seek compensation for your loss. To make sure you get the compensation you deserve, contact the Law Offices of James O. Cunningham, P.A. and schedule your free initial consultation today.
